| dc.description | إن السلطة والحرية من المسائل الهامة في المجتمعات، فإن وجودهما يعتبر من مظاهر قيام الدولة القانونية والديمقراطية ،فإن تحقيق التوزان بينهما يعد أمر حيوي في الأنظمة السياسية و القانونية حيث تسعى مجموعة من اليات على تحقيق التوازن الفعال بين السلطة والحرية، وهذا لمنع تعدي على حقوق وحريات الأفراد حيث يشمل ذلك مجموعة من الأليات، نذكر منها الفصل بين السلطات لتجنب تركيز القوة في يد جهة واحدة و اقرار ضوابط وتوازنات تسمح لكل فرع مراقبة اخر، بالإضافة إلى حماية الحريات الأساسية وحتى الحقوق التي يضمنها القانون والدستور الذي يعتبر أسمى قانون في الدولة، اذ تكمن أهمية هذه الأليات في تعزيز المشاركة السياسية و المجتمعية ،وهذا كله لقيام دولة قانون التي تسهر على الحفاظ على النظام العام. الكلمات المفتاحية السلطة ، الحرية ، الحقوق و الحريات الأساسية ، الدستور summary Authority and freedom are important issues in societies.
