إن للجانب التشريعي والتنظيمي للوقف والزكاة أهمية كبيرة، فإصلاح المنظومة الوقفية بما يسمح لها بالمساهمة الفعالة في التنمية الشاملة أصبح ضرورة حتمية، فمؤسستي الوقف و الزكاة أصبحت اليوم قطاعا ثالثا إلى جانب القطاع العام و الخاص، تلبي الحاجيات الاجتماعية من جهة، و تدعم الاقتصاد الوطني من جهة أخرى ، ففكرة إنشاء كيانالديوان الوطني للأوقاف و الزكاة المستقل و المكلف بتسيير أموال الوقف والزكاة وتنميتها بعيدا عن بيروقراطية الإدارة المركزية فكرة جديرة بالإشادة، إلا أنها تحتاج الى الكثير من التدقيق التشريعي والوظيفي لتدارك ومعالجة الاختلالات التي عرفتها التجارب السابقة والتجارب الحالية. الكلمات المفتاحية: الديوان - الاوقاف - الزكاة. Résumé L'aspect législatif et réglementaire du waqf et de la zakat est d'une grande importance. Réformer le système waqf de manière à lui permettre de contribuer efficacement au développement global est devenu une nécessité inévitable. Les institutions du waqf et de la zakat sont aujourd'hui devenues un troisième secteur aux côtés du public. et le secteur privé, répondant aux besoins sociaux d'une part, et soutenant l'économie nationale d'autre part, l'idée de créer un Bureau national indépendant des dotations et une entité Zakat chargée de gérer et de développer les dotations et la zakat. retirer les fonds de la bureaucratie de l'administration centrale est une idée louable, mais elle nécessite un examen législatif et fonctionnel approfondi pour corriger et remédier aux déséquilibres connus des expériences passées et actuelles. Reforming the waqf system in a waythatallowsit to effectivelycontribute to comprehensivedevelopment has become an inevitablenecessity. The waqf and zakat institutions have todaybecome a thirdsectoralongside the public and privatesectors, meeting social needs on the one hand, and supporting the national economy on the other hand. On the other hand, the idea of establishing an independent National Bureau of Endowments and Zakat entitychargedwithmanaging and developingendowment and zakat fundsawayfrom the bureaucracy of the central administration is a laudableidea, but itrequires a lot of legislative and functionalscrutiny to correct and address the imbalancesknownfromprevious and currentexperiences.
