| dc.description | إن العلاقة التي تحكم المرقي العقاري بالمقتني في عقد البيع على التصاميم ، لا تنتهي بإنجاز البناء ،و إنما تمتد إلى ما بعد ذلك ، لتبقى تحكمها الضمانات التي قررها المشرع الجزائري لحماية المقتني ،و التي يلتزم بها المرقي العقاري ،و تتلخص هذه الضمانات في ضمان حسن التنفيذ بنوعيه ،الإنهاء الكامل للإنجاز و حسن سير عناصر التجهيز ،و كذا ضمان إدارة و تسيير الأملاك المشتركة لمدة سنتين ،كل هذا من أجل ضمان الإنتفاع الكامل بالبناء ، بالإضافة إلى الضمان العشري الذي يلتزم به المرقي العقاري بالتضامن مع بقية المتدخلين الاخرين. الكلمات المفتاحية:المرقي العقاري، عقد البيع على التصاميم، حماية المقتني، البناء، الضمان العشري. Keywords: real estatedeveloper, design sales contract, purchaser protection, construction, ten-yearguarantee Résumé: La relation qui régit le promoteur immobilier avec l'acquéreur dans le contrat de vente conception ne s'arrête pas avec l'achèvement de l'immeuble, mais s'étend bien au-delà, pour rester régie par les garanties que le législateur algérien a décidé de protéger l'acquéreur, et pour auquel s'engage le promoteur immobilier, et ces garanties se résument en : Une garantie de bonne réalisation des deux types, de l'achèvement complet du projet et du bon fonctionnement des éléments d'équipement, ainsi qu'une garantie de gestion et d'administration des la copropriété pour une durée de deux ans, tout cela afin de garantir la pleine jouissance du bâtiment, en plus de la garantie décennale que le promoteur immobilier est tenu de faire en solidarité avec le reste des autres parties prenantes .
