| dc.description | Résumé: لقد تناوانا في مذكرتنا هاته موضوع المحكمة الدستورية سواءا في الجزائر أو مصر إذا حضاهما المشرع الدستوري بأهم وظيفة والمتمثلة في الحفاظ على وثيقة الدستور من الإنتهاك وكذا حماية الحقوق والحريات التي تكفلها هاته الوثيقة من التجاوز حيث أن أهمية هاته الهيئة تتلخص في الدور الكبير المستوحي من صلاحياتها والتي تعد بمثابة الركيزة الأساسية للمحافظة على الدستور وماتجلى لنا من خلال هذه الدراسة أن المشرع الدستوري الجزائري جعل هذه الهيئة ذات صبغة سياسية أكثر منها قضائية أما المشرع الدستوري المصري فهو على خلاف ذلك حيث خولها صلاحيات واسعة للنظر في الشؤون القانونية والقضائية والفصل في المنازعات والدعاوى الدستورية المعروضة عليها غير أن غاية هذه الهيئة واحدة وهي حماية الدستور. Summary of memo: In thismemorandum, we have discussed the subject of the Constitutional Court, whether in Algeria or Egypt, if the constitutionallegislatorassignedthem the most important function, whichis to preserve the constitutional document from violation, as well as to protect the rights and freedomsguaranteed by this document from abuse, as the importance of this body issummed up in the greatroleinspired by itspowers, which It isconsidered the basic foundation for preserving the constitution, and whatbecameclear to us throughthisstudyisthat the Algerian constitutionallegislator made this body more politicalthanjudicial in nature, while the Egyptianconstitutionallegislatoris on the contrary, as itgranteditbroadpowers to considerlegal and judicialaffairs and decide on constitutional disputes and lawsuitspresented to it.
