تتناول هذه المذكرة موضوع المسؤولية الجزائية عن إساءة استغلال الوظيفة في القانون الجزائري، مركزة على الأفعال التي تصدر عن الموظف العمومي حين يتجاوز صلاحياته أو يستغل نفوذه لتحقيق مصلحة شخصية أو الإضرار بالغير. وتستند الدراسة أساسا إلى أحكام قانون العقوبات، وكذا قانون الوقاية من الفساد ومكافحته رقم 06-01، الذي يجرم عدة سلوكيات على غرار الرشوة، المحاباة، استغلال النفوذ، الإهمال العمدي، والتصرف غير المشروع في المال العام. وتتناول المذكرة شروط قيام المسؤولية الجزائية، والتي تتطلب توافر صفة الموظف العمومي، إلى جانب الركنين المادي والمعنوي للجريمة، كما تستعرض العقوبات المقررة قانونا، بما فيها العقوبات الأصلية والتكميلية مثل السجن، الغرامة، والعزل من المنصب. وتهدف هذه الدراسة إلى إبراز خطورة إساءة استغلال الوظيفة على الثقة العامة والمؤسسات، مع تقديم نماذج من الاجتهادات القضائية والمقارنة مع بعض التشريعات الأجنبية، بما يعكس الحرص القانوني على حماية الوظيفة العمومية وتعزيز مبادئ الشفافية والنزاهة. الكلمات المفتاحية: إساءة استغلال الوظيفة - المسؤولية الجزائية - الموظف العمومي - قانون مكافحة الفساد 06-01 Summary : This Thesis addresses the issue of criminal liability for abuse of office under Algerian law, focusing on actions committed by a public employee who exceeds their authority or exploits their influence to achieve personal gain or harm others. The study is based primarily on the provisions of the Penal Code, particularly, as well as Law No. 06-01 on the Prevention and Combating of Corruption, which criminalizes several behaviors such as bribery, favoritism, influence peddling, willful negligence, and the illegal disposal of public funds. The memorandum addresses the conditions for establishing criminal liability, which require the status of a public employee, in addition to the material and moral elements of the crime. It also reviews the penalties prescribed by law, including principal and supplementary penalties such as imprisonment, fines, and removal from office. This study aims to highlight the seriousness of abuse of office on public and institutional trust, while presenting examples of judicial precedents and comparing them with some foreign legislation. This reflects the legal commitment to protecting public office and promoting the principles of transparency and integrity. Résumé en français Ce mémoire aborde la question de la responsabilité pénale pour abus de fonction en droit algérien, en se concentrant sur les actes commis par un agent public qui outrepasse ses pouvoirs ou abuse de son influence pour obtenir un avantage personnel ou nuire à autrui. L'étude s'appuie principalement sur les dispositions du Code pénal, ainsi que sur la loi n° 06-01 relative à la prévention et à la lutte contre la corruption, qui incrimine plusieurs comportements tels que la corruption, le favoritisme, le trafic d'influence, la négligence volontaire et le détournement de fonds publics. Le mémorandum aborde les conditions d'établissement de la responsabilité pénale, qui requièrent la qualité d'agent public, ainsi que les éléments matériels et moraux de l'infraction. Il passe également en revue les sanctions prévues par la loi, notamment les peines principales et complémentaires telles que l'emprisonnement, les amendes et la révocation. Cette étude vise à souligner la gravité des abus de fonction sur la confiance publique et les institutions, tout en présentant des exemples de jurisprudence et en les comparant à certaines législations étrangères, reflétant l'engagement juridique de protéger la fonction publique et de promouvoir les principes de transparence et d'intégrité.
