Abstract

Abstract This thesis addresses the issue of health institutions' disputes in Algerian legislation, as a significant form of administrative litigation involving a fundamental constitutional right: the right to health. The first chapter analyzes the legal framework governing health institutions, focusing on legislative sources related to public health and administrative responsibility. The second chapter is devoted to examining the mechanisms for resolving these disputes, whether administrative, amicable, or judicial, highlighting the role of both public administration and the judiciary in protecting individual rights and ensuring the efficient operation of health services. The study concludes with the recommendation to strengthen these mechanisms to balance public service demands and individual rights.
