Abstract

ملخص تقوم الحرية النقابية في الوظيفة العمومية على ضمان حق الموظفين في إنشاء النقابات والانضمام إليها بحرية، والدفاع عن مصالحهم المهنية دون تمييز. وتشمل هذه الحرية المشاركة في المفاوضة الجماعية، وتمثيل الموظفين أمام الإدارة، وتنظيم الأنشطة النقابية وفق القانون. كما تلتزم الإدارة باحترام استقلال النقابات وعدم التدخل في شؤونها، مما يعزز الحوار الاجتماعي ويحمي حقوق العاملين. وتسهم هذه المبادئ في ترسيخ بيئة عمل عادلة ومتوازنة تدعم الاستقرار الوظيفي لجميع الموظفين دائماً. الكلمات المفتاحية: الحرية النقابية، الوظيفة العمومية، النص والممارسة. Summary Freedom of association in the public sector guarantees the right of employees to freely establish and join unions and to defend their professional interests without discrimination. This freedom includes participation in collective bargaining, representation before management, and the organization of union activities in accordance with the law. Management is also obligated to respect the independence of unions and refrain from interfering in their affairs, thereby promoting social dialogue and protecting workers' rights. These principles contribute to establishing a fair and balanced work environment that supports job security for all employees at all times. Résumé La liberté d'association dans le secteur public garantit aux salariés le droit de créer librement des syndicats, d'y adhérer et de défendre leurs intérêts professionnels sans discrimination. Cette liberté comprend la participation aux négociations collectives, la représentation auprès de la direction et l'organisation d'activités syndicales conformément à la loi. La direction est également tenue de respecter l'indépendance des syndicats et de s'abstenir de toute ingérence dans leurs affaires, favorisant ainsi le dialogue social et la protection des droits des travailleurs. Ces principes contribuent à instaurer un environnement de travail juste et équilibré, garant de la sécurité d'emploi pour tous les salariés en toutes circonstances.
