تفويضات المرفق العام المحلي في الجزائر

Abstract

تقنيّة التفويض هي ظاهرة اقتصادية تبحث عن تخفيف العبء المالي عن الخزينة العمومية، مع تطوير فكرة الاستثمار المؤسساتي، ولها بعد اجتماعييظهر في النهوض بالحاجات الأساسية لجمهور المنتفعين بصورة مرضية وبأقل تكلفة ممكنة، وهي كذلك نظام قانوني تعاقدي حديث المظهر وقديم التطبيق لها عدّة ابعاد قانونيّة، والتي ظهرت كأسلوب تعاقدي في التسيير العمومي بعد أن تمّ طرح المردودية المالية كهدف مستحدث للمرفق العام، لذا اتجهت العديد من الدولة والتي من بينها الجزائر لتنظيمها بعدة نصوص قانونيّة مُتفرقة، ونظراً لمجمع النتائج المرضية التي يمكن أن يحققها هذا الأسلوب في التسيير العمومي، ازدادت الحاجة أكثر لتطبيقه على المستوى المحلي، بسبب معاناة الجماعات الاقليمية من ظاهرة العجز الميزاني، وكذا تدني مستوى الخدمة العمومية المحلية،إذْاتجه المشرع الجزائري لتأطيره في عدة قوانين وتنظيمات خاصة بالإدارة المحلية، قصد إعادة الاعتبار للمرفق العام المحلي، وتدفع بعجلة التنمية في شتى الميادين، لكن الواقع العملي أفرز فعاليته المحتشمة، وذلك لعدة تحديات سياسية واقتصادية وقانونية حالت دون تحقيق الأهداف المرجوة منه. الكلمات الافتتاحية: تقنية التفويض، الجماعات المحلية، المردودية، الجودة، الخدمة العمومية. Abstract : Delegation technic is an economic phenomenon seeking for relieve the public treasury financial burden, including the development of the institutional investment idea, with a social dimension that reflected in promoting the basic needs of the beneficiary public satisfactorily and at the lowest possible cost, it is also a contractual legal system modern in appearance and old in application, with several legal dimensions, which emerged as a contractual method of public management , after the financial feasibility was introduced as an innovative objective of the public service, Many States, including Algeria, have therefore proceeded to regulate it with a series of separate legal texts, given the combination of satisfactory results that can be achieved by this method, there is a greater need to apply it at the local level, as local communities suffer from budgetary deficits, as well as the low level of the local public service, so that the Algerian legislator's proceed to regulate the method by enacting several laws and regulations on local administration, in order to promote the local public service, but, the practical reality has proven its decent effectiveness, given to a number of political, economic and legal challenges that have prevented the achievement of its aims.
