Abstract
Summary:
Resistance is an instinctive act that arises from the depths of human nature, justified by natural justice before positive laws. It is an innate response to any aggression or oppression. Resistance has evolved into a fundamental principle of international law, recognized as a legitimate exception to the principle of prohibiting the use of force, particularly in the context of peoples under occupation. This resistance takes various forms, ranging from peaceful to armed, and is governed by rules that distinguish it from acts of terrorism and violence.
This research is based on a legal foundation of the legitimacy of resistance, using the Palestinian cause as a model where resistance has deep roots and multiple stages, the latest being the "Al-Aqsa Flood" operation that continues to this day. We note that this research aims to highlight how the Palestinian resistance has maintained its natural and legitimate right to liberation, despite distortion and restrictions, while preserving international legitimacy.
