مبدأ حرية الإستثمار بين القانون الجديد والقوانين الخاصة

Abstract

تهدف هذه الدراسة إلى بلورة مقاربة نظرية للتعريف بمبدأ حرية الاستثمار والتجارة في التشريع الجزائري واهم الجاذبات القانونية والسياسية التي تحوم حوله خاصة في التحولات الاقتصادية للدولة . حيث تسعى الجزائر كغيرها من دول العالم إلى مواكبة التحولات الاقتصادية المتسارعة على الساحة الدولية خاصة في المجالين الاقتصادي والمالي ، حيث ساهمت أزمة انهيار أسعار البترول الحالية والتعثر المالي المتمثل في انخفاض احتياطي العملة الصعبة إلى محاولة السلطة الحاكمة لإنعاش الاقتصاد الوطني ،ونظرا للعلاقة الطردية بين التحولات الاقتصادية للدولة ومبدأ حرية الاستثماروالتجارة بحيث يعتبر هذا الأخير المبدأ الأساس في عملية الانفتاح و التحول نحواقتصاد السوق بما يستجيب لمتطلبات جمهور المستثمرين ويساهم في ترقية المشاريع و استقطاب رؤوس الأموال خدمة للصالح العام . الكلمات المفتاحية: الإستثمار - التجارة - رؤوس الأموال. Abstract: This study aims to crystallize a theoretical approach to introduce the principle of freedom of investment and trade in Algerian legislation and the most important legal and political attractions that hover around it, especially in the economic transformations of the state. Where Algeria, like other countries of the world, seeks to keep pace with the rapid economic transformations on the international arena, especially in the economic and financial fields, where the crisis of the collapse of oil prices and the financial distress represented by the decline in hard currency reserves contributed to the attempt of the ruling authority to revive the national economy, and given the direct relationship between the economic transformations of the state and the principle of freedom of investment and trade, so that the latter is the basic principle in the process of openness and transformation towards a market economy in a way that responds to the requirements of the investor public and contributes to the promotion of Projects and attracting capital to serve the public interest. Résumé : Cette étude vise à cristalliser une approche théorique pour introduire le principe de la liberté d'investissement et de commerce dans la législation algérienne et les attraits juridiques et politiques les plus importants qui planent autour de lui, en particulier dans les transformations économiques de l'?tat. Là où l'Algérie, comme d'autres pays du monde, cherche à suivre le rythme des transformations économiques rapides sur la scène internationale, en particulier dans les domaines économique et financier, où la crise de l'effondrement des prix du pétrole et les difficultés financières représentées par la diminution des réserves de devises fortes ont contribué à la tentative du pouvoir de relancer l'économie nationale, et compte tenu de la relation directe entre les transformations économiques de l'?tat et le principe de la liberté d'investissement et de commerce, de sorte que ce dernier est le principe de base dans le processus d'ouverture et de transformation vers une économie de marché d'une manière qui réponde aux besoins du public investisseur et contribue à la promotion de l'économie de marché.
