المسؤولية العشرية للمقاول والمهندس المعماري في مجال البناء

Abstract

لقد جاءت أحكام المسؤولية العشرية بصفة عامة لحماية رب العمل، الطرف الضعيف في العقد، وحماية المال العام من التبديد، فبمقتضى المسؤولية العشرية يخول القانون لرب العمل مسائلة المهندس المعماري والمقاول عن الأضرار التي تصيب البناء،وإلزامهما بالتعويضالجابر عن هذه الأضرار، فالضمان العشري والنظام القانوني المتعلق به وجد من أجل حماية الأشخاص المستثمرين في مجال المقاولات والمنشآت المختلفة، وهذا كافيا لحماية رب العمل الذي لا يكون ملم بهذا المجال، وجراء تحقق الضمان العشري يتوجب على المشيدين سواء المقاول أو المهندس المعماري أن يلتزمابتحقيق نتيجة وهي بقاء البناء الذي شيداه سليما لمدة 10 سنوات بعد تسليمه لرب العمل. الكلمات المفتاحية: المسؤولية العشرية، المقاول، المهندس المعماري، الضمان العشري.
