Abstract

لقد وضع المشرع الجزائري فكرة مراقبة دستورية القوانين موضع التنفيذ منذ أول دستور جزائري حيث خص المجلس الدستوري بالأمر ثم تطور القضاء الدستوري متجاوزا محدودية الاختصاص وكثرة الانتقادات بالرقي إلى مستوى المحكمة الدستورية مع دستور 2020 ذلك أن النظر في أمر مطابقة القانون للدستور من اختصاص المحكمة الدستورية دون غيرها، لأن النص الدستوري الجديد قد أجاز الطعن في دستورية القوانين من طرف الأفراد عند المساس بحقوقهم وحرياتهم التي يكفلها الدستور. résumé Le législateur algérien a mis en pratique l'idée du contrôle de constitutionnalité des lois depuis la première constitution algérienne Là où le Conseil constitutionnel a épinglé la question, la justice constitutionnelle s'est développée, contournant la compétence limitée et le grand nombre de critiques, en s'élevant au niveau de la Cour constitutionnelle avec la constitution de 2020.
