اثار قرارا المحكمة الدستورية في المجال الرقابي على القوانين

Abstract

الملخص : تتمحور هذه الدراسة حول تحليل آثار قرارات المحكمة الدستورية في المجال الرقابي على القوانين، خاصة في ظل التعديل الدستوري الجزائري لسنة 2020 الذي استحدث هذه المؤسسة وأضفى على قراراتها طابعا ملزما ونهائيا، سواء من خلال رقابة المطابقة، او رقابة الدستورية، او رقابة توافق قوانين مع المعاهدات، او رقابة الدفع بعدم الدستورية .حيث كشفت هذه الدراسة عن وجود آثار مباشرة لرقابة المحكمة الدستورية المتمثلة في منع نفاذ النصوص القانونية غير المتوافقة مع الدستور، و آثار غير مباشرة تسهم في تعزيز مبادئ دستورية هامة كالفصل بين السلطات، وحماية الحقوق والحريات وترسيخ مبدأ الامن القانوني . وقد خلصنا إلى أن توسيع دور المحكمة الدستورية ساهم بشكل ملموس في إرساء توازن دستوري، وفتح المجال امام الافراد للمشاركة في الرقابة الدستورية، بما يعزز دولة القانون . Abstract: This study focuses on analyzing the effects of the Constitutional Court's decisions within the framework of legal oversight over legislation, particularly in light of the 2020 Algerian constitutional amendment that restructured this institution and granted its decisions a binding and final character. These effects manifest through conformity control, constitutional review, the compatibility of laws with treaties, and the exception of unconstitutionality. The study reveals the direct effects of the Constitutional Court’s oversight in preventing the enforcement of laws that are inconsistent with the Constitution, as well as indirect effects that contribute to strengthening important constitutional principles such as the separation of powers, the protection of rights and freedoms, and the consolidation of legal security. It concludes that expanding the role of the Constitutional Court has significantly contributed to establishing constitutional balance and opened the door for individuals to participate in constitutional oversight, thereby reinforcing the rule of law. Résumé : Cette étude porte sur l’analyse des effets des décisions de la Cour constitutionnelle dans le cadre du contrôle des lois, notamment à la lumière de la révision constitutionnelle algérienne de 2020 qui a réorganisé cette institution et conféré un caractère contraignant et définitif à ses décisions, que ce soit à travers le contrôle de conformité, le contrôle de constitutionnalité, le contrôle de compatibilité des lois avec les traités, ou le contrôle par voie d’exception d’inconstitutionnalité. L’étude a révélé des effets directs du contrôle exercé par la Cour constitutionnelle, notamment l’empêchement de l’entrée en vigueur des textes juridiques non conformes à la Constitution, ainsi que des effets indirects contribuant à renforcer des principes constitutionnels importants tels que la séparation des pouvoirs, la protection des droits et libertés, et la consolidation de la sécurité juridique. Nous avons conclu que l’élargissement du rôle de la Cour constitutionnelle a contribué de manière tangible à l’instauration d’un équilibre constitutionnel et à l’ouverture de la voie à la participation des individus au contrôle de constitutionnalité, ce qui renforce l’État de droit.
