Abstract

ملخص : تتناول هذه المذكرة بالبحث والتحليل ظاهرة الإجرام المنظم، باعتبارها أحد أخطر التهديدات المعاصرة لحقوق الإنسان والاستقرار العالمي. وتستعرض الدراسة كيف تتجاوز هذه الشبكات الإجرامية الحدود الوطنية مستغلةً ثغرات قانونية وتكنولوجية، لتمارس أنشطة مدمرة كالاتجار بالبشر، وغسيل الأموال وترويج المخدرات، مما يؤدي إلى انتهاكات جسيمة للحق في الحياة والأمن والكرامة، فضلاً عن تقويضها لسيادة القانون وإفسادها للمؤسسات السياسية والاقتصادية. ولمواجهة هذا الخطر يقدم البحث رؤية متكاملة لآليات الحماية على المستويين: الدولي، ويتمثل في الإطار القانوني الذي أرسته اتفاقية باليرمو وبروتوكولاتها، ودور المنظمات الدولية كالإنتربول في تعزيز التعاون القضائي والأمني؛ أما على المستوى الوطني فكان التركيز على التجربة الجزائرية كنموذج، حيث تم التوصل إلى ضرورة تحديث التشريعات وإنشاء هيئات متخصصة، وتبني أساليب تحقيق مستحدثة لمواكبة تطور الجريمة. وتخلص المذكرة إلى أن الحماية الفعالة لحقوق الإنسان من الإجرام المنظم تتطلب استراتيجية شاملة تجمع بين الردع القانوني والتعاون الدولي الوثيق لمجابهة هذه الظاهرة المعقدة والمتغيرة. الكلمات المفتاحية: الإجرام المنظم، حقوق الإنسان، الحماية الدولية والوطنية. Summary: This thesis provides an in-depth analysis of organized crime as one of the most serious contemporary threats to human rights and global stability. The study examines how these transnational criminal networks exploit legal and technological loopholes to engage in destructive activities such as trafficking in persons, money laundering, and drug trafficking. These actions lead to grave violations of the rights to life, security, and dignity, in addition to undermining the rule of law and corrupting political and economic institutions. To confront this threat, the research presents an integrated vision of protection mechanisms at two levels: the international level, represented by the legal framework established by the Palermo Convention and its protocols, and the role of international organizations like Interpol in enhancing judicial and security cooperation; and the national level, focusing on the Algerian experience as a model, highlighting the necessity of modernizing legislation, establishing specialized bodies, and adopting modern investigative techniques to keep pace with the evolution of crime. The thesis concludes that effective protection requires a comprehensive strategy that combines legal deterrence with close international cooperation to address this complex and evolving phenomenon. Résumé : Ce mémoire propose une analyse approfondie du phénomène de la criminalité organisée, considérée comme l'une des menaces contemporaines les plus graves pour les droits de l'homme et la stabilité mondiale. L'étude examine comment ces réseaux criminels transnationaux exploitent les failles juridiques et technologiques pour mener des activités destructrices telles que la traite des êtres humains, le blanchiment d'argent et le trafic de drogue. Ces agissements entraînent de graves violations du droit à la vie, à la sécurité et à la dignité, en plus de saper l'état de droit et de corrompre les institutions politiques et économiques. Pour faire face à cette menace, la recherche présente une vision intégrée des mécanismes de protection à deux niveaux : international, représenté par le cadre juridique établi par la Convention de Palerme et ses protocoles, et le rôle des organisations internationales comme Interpol dans le renforcement de la coopération judiciaire et sécuritaire ; et national, en se concentrant sur l'expérience algérienne comme modèle, soulignant la nécessité de moderniser la législation, de créer des organes spécialisés et d'adopter des techniques d'enquête modernes pour suivre l'évolution de la criminalité. Le mémoire conclut qu'une protection efficace exige une stratégie globale alliant la dissuasion juridique à une coopération internationale étroite pour faire face à ce phénomène complexe et évolutif.
