| dc.description | نظرا للقيمة المادية للعقار التي أصبحت تتزايد والتصرفات الغير مشروعة أدى ذلك الى ضرورة حمايته قانونيا من خلال جهات من شأنها ضبط هذه التصرفات ، وبتطبيقها تؤدي الى الالتزام بالقوانين وعد مخالفتها ،فالعقار هو محور التعامل سواء فيما تعلق بانتقال ملكيته أوكسبها حيث تؤدي هذه الحماية إلى استقرار وضعيته ومنع أي تجاوزات تتسبب في الإضرار بمصالح الناس. وهذا ماأدى إلى ضرورة وجود جهات قضائية خول لهم القانون القيام بهذه المهمة وذلك من اجل تسهيل وإيجاد حلول للعراقيل التي تمنع استغلاله وذلك ببيعه في المزاد العلني، حيث يعد المحضر القضائي احد هذه الجهات التي خولت لها صلاحيات وفق القانون06-03 باعتباره ضابطا عموميا يتولى القيام باجرات التنفيذ وكذا إجراءات الحجز إلى جانب بيع العقار بالمزاد العلني إلى جانب محافظ البيع الذي منحت له صلاحيات ومهام المحضر القضائي بموجب القانون 23-13 المعدل والمتمم لقانون المحضر القضائي. الكلمات المفتاحية:المزاد العلني، بيع العقار، المحضر القضائي،البيوع العقارية. Summary: Given the material value of the property, which has been increasing and the illegal actions, this has led to the need to protectitlegallythrough bodies that control these actions, and by applyingthem, it leads to compliancewith the laws and not violatingthem. This has led to the necessity of havingjudicial bodies authorized by law to carry out thistask in order to facilitate and find solutions to the obstacles thatpreventits exploitation by sellingitat public auction, as the judicial record is one of these bodies that have been grantedpowersaccording to Law 06-03 as itis an officer. In general, heisresponsible for carrying out the implementationprocedures, as well as the seizureprocedures, in addition to selling the propertyat public auction, alongwith the sales governor, whowasgranted the powers and duties of the judicialbailiffaccording to Law 23-13 amending and supplementing the judicialbailifflaw. Le bien fait l'objet de transactions, qu'elles soient liées au transfert de propriété ou à l'acquisition, car cette protection conduit à stabiliser sa situation et à prévenir toute violation portant atteinte aux intérêts des personnes. Cela a conduit à la nécessité de disposer d'organismes judiciaires habilités par la loi à accomplir cette tâche afin de faciliter et de trouver des solutions aux obstacles qui empêchent son exploitation par la vente aux enchères publiques, car le casier judiciaire est l'un de ces organismes qui ont s'est vu attribuer des pouvoirs selon la loi 06-03 puisqu'il s'agit d'un fonctionnaire. En général, il est chargé d'effectuer les procédures d'exécution, ainsi que les procédures de saisie, en plus de vendre le bien aux enchères publiques, aux côtés du gouverneur des ventes. , qui s'est vu attribuer les pouvoirs et devoirs d'huissier de justice conformément à la loi 23-13 modifiant et complétant la loi sur l'huissier de justice.
