النظام القانوني للتاجر الاجنبي

Abstract

الملخص تدخل المشرع الجزائري لتنظيم ممارسة التجارة من قبل الأجانب، وتحديد شروطها مستهدفا حماية الأمن الوطني والمصلحة العامة من جهة، ومراقبة وضعية الأجانب وأنشطتهم على التراب الوطني من جهة أخرى، لذا نص صراحة على أنه يجب على التاجر الأجنبي أن يقدم الوثيقة التي تخوله الإقامة على التراب الوطني. يترتب على ذلك أنه لا تسلم بطاقة التاجر الى الأجانب الذين لا يثبتون حيازة بطاقة إقامة خاصة بهم والبطاقة المهنية لممارسة الأنشطة التجارية حيث تترتب عليه التزامات في القواعد العامة، تتمثل في القيد في السجل التجاري ومسك الدفاتر التجارية اما في القواعد الخاصة، وهي الالتزامات الضريبية و الشبه ضريبية وبالتالي التاجر الأجنبي يخضع للتشريع الجاري به العمل والمتعلق بوضعية الأجانب أي الاحكام التي تنظم تنقل الرعايا الأجانب في الجزائر، واقامتهم كما يخضع أيضا للأحكام العامة المنصوص عليها في القانون التجاري و قانون الاستثمار 22-18 وللنصوص المعدلة او المتممة له شأنه في ذلك شأن التاجر الجزائري. Le législateur algérien intervient pour réglementer la pratique du commerce par les étrangers, en déterminant les conditions, visant à protéger la sécurité nationale et l'intérêt public d'une part et de surveiller le statut et les activités des étrangers à l'intérieur du pays d'autre part. donc le commerçant étranger doit présenter le document qui confirme sa résidence sur le territoire nationale par conséquent, la carte de commerçant ne sera pas délivrée aux étrangers qui ne justifient pas la possession d'une carte de séjour spéciale et d'une carte professionnelle, qui leur permet d'exercer des activités commerciales car ils soumis obligations découlant des règles générales, notamment l'inscription au registre du commerce et la tenue de livres commerciaux. Quant aux règles spéciales, qui sont des obligations fiscales et parafiscales. Ainsi, le commerçant étranger est soumis à la législation en vigueur relative aux dispositions réglementant la circulation et le séjour des ressortissants étrangers en Algérie, ainsi qu'aux dispositions générales prévues par le code de commerce et le code d'investissements 22-18 et le texte modifié qui le complète met le statut du commerçant étranger similaire à celui du commerçant algérien. The Algerian project intervened to regulate the practice of trade by foreigners and determine its conditions aiming to protect national security, and the public interest on the one hand and to monitor the situation foreigners and there activities on the national territory on the other hand, therefore its exciplicity stipulated that the foreigners trade must present the document authorizing residency on the national territory, with the consequence that the merchant card is not issued, to foreigners who do not prove the possession of their own residence card and professional stipulated in the commercial code and in investment code 22-18 and to the texts amending or supplementing it, as is the case with the Algerian trader.
