الإلتزامات الناشئة عن العقود الإلكترونية في التشريع الجزائري

Abstract

عد المعاملات التجارة الالكترونية اليوم احد أهم مميزات العصر الحديث, نظرا للتطور التكنولوجي الحاصل في وسائل الاتصالات ورقمتنها, وكان لازمة كورونا اثر في انتشار المعاملات الالكترونية والاعتماد على خاصية الأونلاين بسبب الحظر الذي فرض على العالم. نظرا لهذا التطور كان لزاما على المشرع الجزائري تنظيم قانون يؤطر هذه المعاملات التجارية الالكترونية, فاصدر القانون رقم18-05 المتعلق بالتجارة الالكترونية, حيث كان للمورد الالكتروني النصيب الأكبر منه باعتباره الأساس الذي يقوم عليه النشاط من خلال النص على مركزه القانوني والشروط الواجب توافرها لممارسة هذا النشاط, واهم الالتزامات التي تقع على عاتقه, بغية ضمان حقوق المستهلك الالكتروني وحمايته من المخاطر التي قد تقع مستقبلا. الكلمات المفتاحية: التجارة الالكترونية, المورد الالكتروني,المستهلك الالكتروني, التزامات المورد الالكتروني, حقوق المستهلك الالكتروني. Abstract Today, e-commerce is one of the most important features of the modern era, which is based on digitization and teleconference in a virtual world. It has been made more important by the spread of corona virus and the recent ban on the world, which has led to its spread and the world's dependence on the online feature. In view of this development, the Algeria legislator was obliged to organize a law framing this plate, in order to keep pace with the development, that has taken place. It gave confidence in such transactions. If it had been too late for some other legislation, it would have provided for law 05_18 en electronic commerce, where the electronic supplier was the share. The electronic supplier was the largest share as the underlying party of this activity and the conditions for its acquisition of supplier status and obligation ,in order to protect the electronic consumer from risks.
