النظام القانوني لهيئة وسيط الجمهورية

Abstract

لقد أنشئ وسيط الجمهورية بموجب المرسوم الرئاسي رقم 20-45 المؤرخ في 21 جمادى الثانية 1441 الموافق ل 15 فبراير 2020 الذي يتضمن وسيط الجمهورية، إن وسيط الجمهورية هيئة طعن غير قضائية تساهم في حماية حقوق المواطنين وحرياتهم وفي قانونية سير المؤسسات والإدارات العمومية، ويتمتع وسيط الجمهورية بصلاحيات المتابعة والرقابة العامة التي تسمح له بتقدير حسن علاقات الإدارة بالمواطنين، إن الرؤية التي كانت وراء إنشاء هذه الهيئة رؤية واقعية ومسؤولة تؤمن بضرورة تحسين الخدمة العمومية، من خلال مبادئ تطبيق الحكم الراشد، ومحاربة البيروقراطية والتعسف الإداري. الكلمات المفتاحية: وسيط الجمهورية ، حقوق المواطن و حرياتهم ، علاقة الادارة بالمواطن .

Abstract: The Mediator of the Republic was established by virtue of Presidential Decree No. 20-45 of Jumada II 21, 1441 corresponding to February 15, 2020, which includes the Mediator of the Republic. With the powers of follow-up and public oversight that allow him to assess the good relations of the administration with the citizens, the vision that was behind the establishment of this body is a realistic and responsible vision that believes in the necessity of improving public service, through the principles of applying good governance, fighting bureaucracy and administrative arbitrariness. Résumé : Le Médiateur de la République a été institué en vertu du décret présidentiel n° 20-45 du 21 joumada II 1441 correspondant au 15 février 2020, auquel appartient le Médiateur de la République, doté des pouvoirs de suivi et de contrôle public qui permettent d'évaluer les bonnes relations de l'administration avec les citoyens, la vision qui a présidé à la création de cet organe est une vision réaliste et responsable qui croit en la nécessité d'améliorer le service public, à travers les principes d'application de la bonne gouvernance, de lutte contre la bureaucratie et arbitraire administratif.
