تاثير الازمات الصحية على نشاط المرافق العمومية

Abstract

الملخّص: تتناول هذه المذكرة بالدراسة والتحليل موضوع الأزمات الصحية وانعكاسها على سير المرافق العمومية، وذلك من خلال التركيز على جائحة كوفيد-19 كنموذج واقعي كشف عن مدى هشاشة البنية الإدارية والتنظيمية في مواجهة الظروف الإستثنائية. وقد سعت الدراسة إلى فهم كيفية تأثير الأزمة الصحية على مبدأ استمرارية المرافق العامة، وعلى جودة الخدمات العمومية، من خلال الجمع بين التأصيل النظري والتحليل القانوني للمفاهيم المرتبطة بالأزمة والمرفق العام. كما تم تخصيص جانب تطبيقي لتحليل التجربة الجزائرية خلال الجائحة، والوقوف على أهم التدابير المتخذة من قبل الإدارة لضمان الخدمة العمومية رغم التحديات. وضرورة تبني إصلاحات تشريعية وإدارية شاملة، تعزز من مرونة المرافق العامة وتضمن فعاليتها في حالات الطوارئ الصحية، عبر تحديث أنماط التسيير، وتكريس مبدأ الإستباقية القانونية، وتفعيل أدوات الرّقمنة. الكلمات المفتاحية: الأزمة الصحية، المرفق العمومي، كوفيد-19، القانون الإداري. Abstract: This thesis explores the impact of health crises on the functioning of public services, with a particular focus on the COVID-19 pandemic as a real-world example that exposed the fragility of administrative and institutional structures under exceptional circumstances. The study aims to understand how such crises affect the principle of continuity in public service delivery and examines the legal and administrative frameworks surrounding both health emergencies and public institutions. The research includes an applied analysis of Algeria’s experience during the pandemic, highlighting key measures taken by public authorities to ensure the continuation of essential services. With recommendations for legislative and structural reforms that would enhance the flexibility and resilience of public services, through legal preparedness, updated administrative practices, and the integration of digital tools.
