اثر الرقابة الدستورية على سيادة البرلمان في ظل التعديل الدستوري 2020

Abstract

ملخص: تهدف هذه الدراسة إلى تسليط الضوء على أثر الرقابة الدستورية على سيادة البرلمان في ظل التعديل الدستوري لسنة 2020 من خلال تناول تدخل المحكمة الدستورية في مختلف المبادرات التشريعية سواء تعلق الأمر بتعديل الدستور، أو المعاهدات الدولية أو القوانين العضوية والعادية، وقد توصلت الدراسة إلى أن توسع اختصاصات الرقابة الدستورية يحافظ على مبدأ سمو الدستور من المنظور الايجابي وهذا ما يعكس سلبا على سيادة البرلمان بتقليص مدى استقلاليته التشريعية. الكلمات المفتاحية: الرقابة الدستورية، المحكمة الدستورية، التعديل الدستوري لسنة 2020، الدستور، المعاهدات الدولية، القوانين العضوية، القوانين العادية.

Abstract : This study aims to shed light on the impact of constitutional review on the sovereignty of Parliament in light of the 2020 constitutional amendment, by addressing the intervention of the Constitutional Court in various legislative initiatives, whether related to constitutional amendments, international treaties, organic laws, or ordinary laws. The study concludes that the expansion of the Constitutional Court's powers preserves the principle of the supremacy of the Constitution from a positive perspective, which negatively affects the sovereignty of Parliament by limiting the extent of its legislative independence. Résumé Cette étude vise à mettre en lumière l'impact du contrôle de constitutionnalité sur la souveraineté du Parlement à la lumière de la révision constitutionnelle de 2020, en abordant l'intervention de la Cour constitutionnelle dans les différentes initiatives législatives, qu’il s’agisse de la révision de la Constitution, des traités internationaux, des lois organiques ou des lois ordinaires. L’étude conclut que l’élargissement des compétences de la Cour constitutionnelle permet de préserver le principe de la suprématie de la Constitution d’un point de vue positif, ce qui se répercute négativement sur la souveraineté du Parlement en réduisant l’étendue de son indépendance législative.
