الآثار القانونية المترتبة عن عقد حفظ الحق

Abstract

تعتبر هذه الدراسة بحثا لموضوع الأثار القانونية المترتبة عن عقد حفظ الحق وفق القانون رقم 11-04 المحدد للقواعد التي تنظم نشاط الترقية العقارية. حيث تطرقنا في الفصل الأول إلى الإلتزامات المرقي العقاري في عقد حفظ الحق وقسمناه إلى مبحثين: المبحث الأول إلتزامات المرقي العقاري حتى تمام إنجاز أشغال البناء، أما المبحث الثاني إلتزاماته بعد تمام إنجاز أشغال البناء. كما كان الفصل الثاني مخصص إلى إلتزامات صاحب حفظ الحق في هذا العقد ،وقمنا بدوره إلى تقسيمه إلى مبحثين: المبحث الأول إلتزام صاحب حفظ الحق بدفع التسبيق النقدي لثمن العقار المحفوظ، أما المبحث الثاني إلتزامه بالشراء. الكلمات المفتاحية: الأثار القانونية ،عقد حفظ الحق، المرقي العقاري، صاحب حفظ الحق.

Summary: This study is considered a research on the subject of the legal effects of the contract of preservation of the right in accordance with Law No. 11-04 specifying the rules governing the activity of real estate promotion. Where we dealt in the first chapter to the obligations of the real estate promoter in the contract of preservation of the right and divided it into two sections: the first section obligations of the real estate promoter until the completion of construction works, and the second section his obligations after the completion of construction work. The second chapter was also dedicated to the obligations of the owner of the right to save the right in this contract, and we in turn to divide it into two sections: the first section is the commitment of the owner of the right to pay the cash advance for the price of the preserved property, and the second section is his commitment to purchase.
