إن الحماية القانونية للتراث الثقافي عامة و الممتلكات الثقافية العقارية خاصة تشكل هدفا استراتيجيا يجب ان تعمل على تحقيقه كافة الهيآت و المؤسسات التي لها علاقة بالموضوع ، ليس فقط أهميتها بل لأنها تشكل الهوية و الذاكرة التاريخية للإنسان عامة و للجزائر خاصة ،و هدف هذه الدراسة هو إبراز نظام نزع الممتلكات الثقافية العقارية في ظل القانون 98/04 المتعلق بحماية التراث الثقافي . فكما هو معلوم فان المشرع الجزائري من خلال إقراره لهذا النظام سعى لحماية هذه الممتلكات من التخريب و الاندثار باعتبارها تتصف بصفة الملك العام و هذا نظرا لطبيعتها الخاصة التي تمتاز بها ، غير أن هذا الأخير أحال تطبيق هذا النظام إلى القواعد العامة مما أثار الكثير من التساؤلات حول كيفية تطبيقه والمشاكل العملية سواء على الصعيد الإداري أو على صعيد المحاكم الإدارية المختصة مما انعكست سلبا على انعدام الحماية الكافية لهذه الممتلكات . وضمانا لاحترام الإدارة لكل الإجراءات عند إجرائها لعملية نزع الملكية و معرفة الأثر الميداني له تطرقنا له في بحثنا هذا من خلال طرح مجموعة من الإشكاليات حول خصوصية عملية نزع الممتلكات الثقافية العقارية و الإجراءات المتبعة في تنفيذ عملية النزع و ما يميزها عن عمليات نزع الممتلكات في ظل القواعد العامة. الكلمات المفتاحية :الممتلكات الثقافية العقارية، نزع الملكية الثقافية العقارية Study summary: The legal protection of cultural heritage in general and real estate cultural property in particular constitutes a strategic goal that all bodies and institutions related to the subject must work to achieve, not only its importance but also because it constitutes the identity and historical memory of humans in general and of Algeria in particular. The goal of this study is to highlight The system of expropriation of real cultural property under Law 98/04 relating to the protection of cultural heritage. As is known, the Algerian legislator, by approving this system, sought to protect this property from vandalism and extinction, as it is characterized by the status of public property, and this is due to its special nature that characterizes it. However, the latter referred the application of this system to general rules, which raised many questions about How to apply it and the practical problems, whether at the administrative level or at the level of the competent administrative courts, which negatively affected the lack of adequate protection for these properties. To ensure that the administration respects all procedures when conducting the expropriation process and to know its field impact, we addressed it in this research by presenting a group of problems about the specificity of the process of expropriation of real cultural property and the procedures followed in implementing the expropriation process and what distinguishes it from expropriation processes under the rules. the public. key words : Real cultural property, expropriation of real cultural property résumé : La protection juridique du patrimoine culturel en général et des biens culturels immobiliers en particulier constitue un objectif stratégique que tous les organismes et institutions concernés par le sujet doivent œuvrer à atteindre, non seulement pour son importance mais aussi parce qu'il constitue l'identité et la mémoire historique des personnes en en général et de l'Algérie en particulier. L'objectif de cette étude est de mettre en lumière le régime d'expropriation des biens culturels immobiliers en vertu de la loi 98/04 relative à la protection du patrimoine culturel. Comme on le sait, le législateur algérien, en approuvant ce système, a cherché à protéger ce bien du vandalisme et de l'extinction, car il se caractérise par le statut de bien public, et cela est dû à sa nature particulière qui le caractérise cependant. a renvoyé l'application de ce système à des règles générales, ce qui a soulevé de nombreuses questions sur la manière de l'appliquer et sur les problèmes pratiques, que ce soit au niveau administratif ou au niveau des tribunaux administratifs compétents, qui ont eu un impact négatif sur le manque de protection adéquate de ces propriétés. . Afin de garantir que l'administration respecte toutes les procédures lors de la conduite du processus d'expropriation et de connaître son impact sur le terrain, nous l'avons abordé dans cette recherche en présentant un ensemble de problèmes sur la spécificité du processus d'expropriation de biens culturels immobiliers et les procédures suivies dans sa mise en œuvre. le processus d'expropriation et ce qui le distingue des processus d'expropriation en vertu des règles publiques. mots clés: Biens culturels immobiliers, expropriation de biens culturels immobiliers
