جريمة الوشاية الكاذبةهيالفعل المنصوص والمعاقب عليه في المادة 300 من قانون العقوبات الجزائري، وتعد خروجا عن المباح وهو البلاغ الصادق إلى التجريم وهو البلاغ الكاذب،وهي من الجرائم العمدية المنتشرة داخل المجتمع والتي يصعب إثباتها. والعلّة من تجريمالوشاية الكاذبة كونها تمس بحق الأفراد والمجتمع،فهي اعتداء على شرف المجني عليه وإعتباره، إذ تنسب إليه واقعة غير صحيحة تستوجب عقابه بعقوبة جزائية أو تأديبية فتسيئ إلى مكانته الاجتماعية . Résumé des notes Le crime de dénonciation calomnieuse est l'acteprévu et puni par l'article300du code pénal algérien, et il est considéré comme un dérogation à ce qui est permis, qui est la communication honnête, à la criminalisation, qui est la fausse commination.
