Abstract

Abstract: The Algerian legislator has established a progressive legal framework for the protection of minors, taking into account their mental and psychological development. A distinction is made between legal capacity to have rights and legal capacity to exercise them, linking such capacity to age and the ability to discern. The legislator also considered legal, mental, psychological, and material impediments that may affect the minor's capacity. As part of this protection, a minor is restricted from disposing of their assets unless the act is purely beneficial. Otherwise, any disposition must be carried out by the legal representative, whether a guardian, curator, or trustee, depending on the legal status. In cases of necessity and when a clear and confirmed benefit to the minor exists, the sale of immovable property may be authorized, but only with prior judicial approval, which serves as a safeguard to protect the minor's property rights. The legislator has regulated such sales under the Algerian Code of Civil and Administrative Procedure, requiring that sales be conducted through a public auction to ensure transparency and achieve the highest possible return. The court must appoint a sworn expert to assess the market value of the property. The court also sets the terms and conditions of the sale, and a notice of the auction is published accordingly. The judgment confirming the auction’s outcome constitutes an enforceable title issued by the court and is not subject to appeal. As a result, ownership is transferred to the successful bidder upon payment of the price, and the legal effects of the judgment take effect immediately upon its issuance.
