Abstract
Summary of note
This study sheds light on the extent to which the Algerian legislator has succeeded in striking a balance between individuals' interests in the inviolability of their private lives and the public interest of the State and society in combating crimes by permitting interference with an individual's right to the inviolability of their private life.
The Algerian legislator has guaranteed the protection of the right to privacy by criminalizing wiretapping and photography. At the same time, the legislator has permitted infringement of this right by allowing wiretapping and photography in the Code of Criminal Procedure.
In this study, we addressed the criminalization of violating individuals' privacy through wiretapping and photography. We analyzed the crimes stipulated and the penalties prescribed in Articles 303 bis to 303 bis 3 of the Algerian Penal Code, and we examined their elements and legal prosecution procedures.
This study showed that this criminalization is not absolute and is restricted by the necessity of protecting public interest. This restriction is found in Algerian Code of Criminal Procedure texts, specifically in Articles 65 bis 5 to 65 bis 10, which relate to special investigative methods such as intercepting communications, recording voices, and taking photographs. Furthermore, the legal and procedural controls that define the scope of implementing these methods were clarified, which we consider to be procedural protection for the individual's right to the inviolability of their private life and protection from any abuse under the guise of procedural legality.
Consequently, this approach represents striking a balance between the individual's right to privacy and the right of the state and society to establish justice.
