دور القاضي في الرقابة على إجراءات مسح الأراضي

Abstract

إن عملية مسح الأراضي من أهم المسائل المشاعة في العقار ، إذ تنبثق منها عدة مشاكل عملية وقانونية جراء عملية تطهير الملكية العقارية وعملية مسح العقارات بدورها تمر بمجموعة من الإجراءات التقنية والقانونية بغرض تشخيص الممتلكات العقارية ، إذ هذه الإجراءات التقنية متمثلة في العمل الميداني المنجز من طرف فرق المسح العقاري المنحصر في عملتي جمع الوثائق والتقسيم البلدي إلى جانب عملتي التحديد والتحقيق العقاري بغية توضيح هوية العقار ومعاينة حقوق الملكية وأخيراإيداع الوثائق بالبلدية أماالإجراءات القانونية تلك التي يقوم بها المحافظ العقاري من خلال إيداع الوثائق المسحية بالمحافظة العقارية وترقيم العقارات الممسوحة قصد إعداد الدفتر العقاري ويترتب على هذه الإجراءات جملة من الاحتجاجات من قبل الأشخاص ليتم الفصل فيها وديا عن طريق محاولة الصلح أو إحالتها للقضاء ، مما ينتج عن هذه الاعتراضات مشكل تضارب الاختصاص القضائي والذي اعتمد المشرع الجزائري من خلاله على المعيار العضوي في تحديد الاختصاص القضائي فوزعه بين القضاء العادي والقضاء الإداري . الكلمات المفتاحية: مسح الأراضي، مسح العقارات، والتحقيق العقاري، المحافظة العقارية. Abstract: The process of land surveyingis one of the mostcommon issues in real estate, as severalpractical and legalproblemsemergefromit as a result of the process of purifying real estateproperty. The process of real estatesurveying, in turn, goesthrough a set of technical and legalprocedures for the purpose of diagnosing real estateproperties, as thesetechnicalprocedures are represented in the fieldworkcarried out by teams The real estatesurveywhichisconfined to the twocurrencies of document collection and municipal division alongwith the twocurrencies of real estate identification and real estate investigation in order to clarify the identity of the property and inspect the propertyrights and finallydeposit the documents in the municipality. On theseprocedures a number of protests by people to besettledamicably by attempting to reconcile or referthem to the judiciary, whichresults in these objections the problem of conflictingjurisdiction, throughwhich the Algerian legislatorrelied on the organiccriterion in determining the jurisdiction, sohedivideditbetween the ordinaryjudiciary and the administrative judiciary. résumé: Le processus d'arpentage est l'un des problèmes les plus courants dans l'immobilier, car plusieurs problèmes pratiques et juridiques en découlent à la suite du processus d'épuration de la propriété immobilière.Le processus d'arpentage immobilier, à son tour, passe par un ensemble de procédures techniques et juridiques en vue du diagnostic des biens immobiliers, ces procédures techniques étant représentées dans les travaux de terrain menés par les équipes L'enquête foncière qui se cantonne aux deux monnaies de collecte documentaire et de division communale ainsi que les deux monnaies d'identification immobilière et d'enquête immobilière afin de clarifier l'identité de la propriété et d'inspecter les droits de propriété et enfin de déposer les documents dans la municipalité.Sur ces procédures un certain nombre de protestations de personnes à régler à l'amiable en tentant de concilier ou les renvoyer au pouvoir judiciaire, ce qui entraîne dans ces objections le problème du conflit de compétence, à travers lequel le législateur algérien s'est appuyé sur le critère organique pour déterminer la compétence, qu'il a donc répartie entre la justice ordinaire et la justice administrative.
