Abstract

الوقف نظام شرعي قائم بذاته، وباب من أبواب الفقه الإسلامي يهدف إلى حبس العين على حكم الله تعالى والتصديق بثمارها على جهة من جهات البرء فهو نوع من أنواع الصدقات الجارية تنفع صاحبها بعد موته، حيث تتضافر الجماعات في إعانة المعوزين وإقامة دور العبادة الخيرية به، فما كان ليُعمر بيت المال من غير وقف. نصت المادة 217 من قانون الأسرة الجزائري على أنه" يثبت الوقف بما تثبت به الوصية" ومع صدور قانون الأوقاف الجزائري رقم91-10 جعل المشرع إثبات الأملاك الوقفية بجميع طرق الإثبات الشرعية والقانونية وبهذا يكون المشرع قد سهل عملية استرجاع الأملاك الوقفية وإن طال الزمن. الكلمات المفتاحية: الوقف، قانون الأوقاف، طرق الإثبات، الأملاك الوقفية.
