بدائل تنفيذ العقوبة خارج المؤسسة العقابية في التشريع الجزائري

Abstract

لقد تبني بالمشرع الجزائري بدائل تنفيذ العقوبة وفي مقدمتهم وقف تنفيذ العقوبة كعقوبة تقليدية المنصوص عليها في قانون الإجراءات الجزائية ،إضافة الي عقوبة العمل لنفع العام المنصوص عليها في قانون العقوبات ،ضف إلى ذلك نظام الوضع تحت المراقبة الالكترونية بموجب قانون 18-01 المؤرخ في 30 يناير 2018 ، المعدل و المتمم للقانون 05-04 قانون تنظيم السجون وإعادة إدماج الاجتماعي للمحبوسين، بهدف إصلاح المحكوم عليهم وإعادة إدماجهم في المجتمع، وتقليل من استخدام العقوبات السالبة للحرية قصيرة المدة. Note summary The Algerian legislator has adopted alternatives to the implementation of the penalty, foremost of which is the suspension of execution of the penalty as a traditional punishment stipulated in the Code of Criminal Procedures, in addition to the penalty of working for the public benefit stipulated in the Penal Code, in addition to that the system of placing under electronic surveillance according to Law 01-18 of January 30 2018, amending and supplementing Law 05-04 of the Prison Organization and Social Reintegration of Detainees Law, with the aim of reforming convicts and reintegrating them into society, and reducing the use of short-term custodial sentences.

Résumé des notes Le législateur algérien a adopté des alternatives à l'application de la peine, au premier rang desquelles le sursis à exécution comme peine traditionnelle prévue par le Code de procédure pénale, en plus de la peine de travail d'utilité publique prévue par la Code pénal, en plus de cela le régime de mise sous surveillance électronique selon la loi 01-18 du 30 janvier 2018, modifiant et complétant la loi 05-04 de la loi sur l'organisation pénitentiaire et la réinsertion sociale des détenus, dans le but de réformer les condamnés et leur réinsertion dans la société et la réduction du recours aux peines privatives de liberté de courte
