جريمة اختطاف الاشخاص في القانون الجزائري

Abstract

تناولتدراستنا الجانب الموضوعي والجانب الاجرائي لجريمة اختطاف الأشخاص، من خلال عرض مفهومها وخصائصها، وأركانها واجراءات المتابعة والمحاكمة،بالإضافة إلى الجرائم المرتبطة بها، والتي تكون في الغالب هي الدافع للاختطاف ، كالاغتصاب والتعذيب الجسدي. فجريمة اختطاف الاشخاص من الجرائم الشائعة و الخطيرة في وقتنا الحالي و باعتبار ان المشرع الجزائري رأى ان الحق في الحرية الفردية حق جدير بالحماية القانونية قام بوضع قانون خاص يحمي حرية الأفراد في التنقل و التجوال و هو القانون رقم 15 20 المتعلق بالوقاية من جرائم اختطاف الاشخاص و مكافحتها.

Summary: Our studydealtwith the objective and procedural aspects of the crime of kidnapping people, by presentingits concept, characteristics, elements, follow-up and trial procedures, in addition to the crimes associatedwithit, which are often the motive for kidnapping, such as rape and physical torture. The crime of kidnapping people is one of the common and serious crimes at the present time, and consideringthat the Algerian legislatorsawthat the right to individualfreedomis a right worthy of legal protection, hedrafted a speciallawthatprotects the freedom of movement and roaming of individuals, whichis Law No. 15 20 related to the prevention of crimes of kidnapping of persons and combat it.

Résumé: Notre étude a traité des aspects objectifs et procéduraux du crime d'enlèvement de personnes, en présentant son concept, ses caractéristiques, ses éléments, ses procédures de suivi et de jugement, ainsi que les crimes qui lui sont associés, qui sont souvent le motif de l'enlèvement, tels que que le viol et la torture physique. Le crime d'enlèvement de personnes est l'un des crimes courants et graves à l'heure actuelle, et considérant que le législateur algérien a vu que le droit à la liberté individuelle est un droit digne de protection juridique, il a rédigé une loi spéciale qui protège la liberté de mouvement et l'itinérance des personnes, qui est la loi n° 15 20 relative à la prévention des délits d'enlèvement de personnes et à leur lutte
