Abstract

ملخص البحث: الجريمة البيئية هي ظاهرة اجتماعية و أن التجريم بحد ذاته هو الحكم الذي يصدر عن الجماعة على بعض أنواع سلوكيات الأفراد، إذ تهدف هذه الدراسة إلى محاولة الكشف عن أهم الأسباب التي أدت إلى الجريمة البيئية، معرفة السلوك الإجرامي والعادة الاجتماعية وحتى الاقتصادية وكذا القانونية، كما لها أهمية من الجانب العلمي هي زيادة الرصيد المعرفي و إدراج هذا العمل ضمن الدراسات السابقة. ولدراسة هذا الموضوع تم طرح الإشكال التالي: هل لنوعية التنشئة الاجتماعية دخل في إقبال بعض الأفراد على الجرائم البيئية؟ إذ تفرع السؤال العام إلى أسئلة فرعية كالتالي: - هل غياب الدور التحسيسي و التوعوي علاقة بانتشار الجرائم البيئية بأنواعها المختلفة ؟ - هل هناك علاقة بين إقبال الأفراد على ارتكاب الجريمة البيئة و غياب الردع من طرف السلطات؟ وضعت فرضيات لاختبارها، تم تحديد المنهج الوصفي التحليلي من أجل الدراسة مع عينة عشوائية، إذ تمت الدراسة على 90 فردا، استعملنا أداة الاستمارة، توصلت الدراسة إلى نتيجة مفادها أن الأساليب التنشئة الاجتماعية غير كافية حول موضوع البيئة و تلوثها، عدم قيام وسائل الإعلام بالتوعية الكافية حول قضية التلوث و الجرائم التي ترتكب في حق البيئة، خاصة و أنها تقوم بعملية التحسيس فقط في المناسبات و هذا غير كافي مقارنة بحجم جرائم التعدي على البيئة.

Research Summary: Environmental crime is a social phenomenon and that criminalization itself is the judgment issued by the group on some types of behavior of individuals, as this study aims to try to reveal the most important reasons that led to environmental crime, knowing criminal behavior and social and even economic and legal habits, as well as its It is important from the scientific point of view to increase the balance of knowledge and to include this work in previous studies. In order to study this subject, the following problem was raised: Does the quality of social upbringing have any effect on the tendency of some individuals to commit environmental crimes? The general question was divided into sub-questions as follows: - Is the absence of the awareness-raising role related to the spread of environmental crimes of different types? - Is there a relationship between the willingness of individuals to commit environmental crime and the absence of deterrence by the authorities? Hypotheses were developed to test them. The analytical descriptive method was determined for the study with a random sample. The study was conducted on 90 individuals. We used the questionnaire tool. The study concluded that the methods of socialization are insufficient on the issue of the environment and its pollution, and the media does not raise sufficient awareness. On the issue of pollution and the crimes committed against the environment, especially as it raises awareness only on occasions, and this is insufficient compared to the size of the crimes of encroachment on the environment.
