Abstract

ملخص أقر المشرع الجزائري عند استجواب المتهم أمام قاضي التحقيق ضمانات قانونية لعدم التجاوز من قبل السلطة المختصة وضياع حق من حقوقه أو حرياته، وخول المشرع سلطة إجراء الاستجواب لقاضي التحقيق، ووضع جزاء مخالفة هذه الضمانات والقواعد القانونية البطلان، ذلك أن الاستجواب إجراء حساس وجوهري يتطلب احتراما صارما حتى تكون العدالة الجزائية في الجزائر أكثر نجاعة وإنصافا. الكلمات المفتاحية: الاستجواب، الضمانات القانونية، قاضي التحقيق.

Summary When interrogating an accused before an investigating judge, the Algerian legislator has established legal guarantees to prevent abuse by the competent authority and the loss of any of his rights or freedoms. The legislator has granted the investigating judge the authority to conduct the interrogation and has set the penalty for violating these guarantees and legal rules as nullity. This is because interrogation is a sensitive and essential procedure that requires strict respect in order for criminal justice in Algeria to be more effective and fair. Résumé Lors de l'interrogatoire d'un accusé devant un juge d'instruction, le législateur algérien a instauré des garanties légales afin d'empêcher tout abus de l'autorité compétente et toute perte de ses droits et libertés. Le législateur a conféré au juge d'instruction le pouvoir de mener l'interrogatoire et a prévu la nullité de la peine en cas de violation de ces garanties et règles légales. En effet, l'interrogatoire est une procédure sensible et essentielle qui exige son strict respect pour une justice pénale plus efficace et plus équitable en Algérie.
