Abstract

ملخص : كرس المشرع الجزائري الوساطة بموجب القانون رقم 08-09 وهي وسيلة بديلة لإجاد حل ودي للنزاع العقاري بيت الخصوم بمساعدة شخص محايد ونزيه وكفء ومحلف هو الوسيط القضائي، ولنجاح الوساطة القضائية في حل المنازعات العقارية يجب على القاضي بذل كل الجهود لإقناع الخصوم بها، وعلى الخصوم السعي الفعلي بحسن نية لإجاء تسوية للنزاع، وعلة الوسيط العمل على تقريب وجهات النظر بين الخصوم. الكلمات المفتاحية :الوساطة القضائية، المنازعات العقارية، الوسيط القضائي.
