العمل الإنتخابي كآلية لشرعية المؤسسات السياسية في الجزائر.

Abstract

تعتبر ألية الحماية الإدارية و القضائية و كذلك تكريس معايير الإستقلالية و المصداقية لشفافية و شرعية العملية الإنتخابية مكسبا حقيقيا للأمة من أجل تحقيق الإنتقال الديمقراطي و تحقيق مبدأ التداول السلمي على السلطة ، فكانت السلطة الوطنية المستقلة للإنتخابات مكسبا دستوريا لسنة 2020 كضمانة لشفافية الإنتخابات في مختلف المراحل التى تمر عليها ، بالإضافة الى الأليات القضائية المجسدة أولا في المحكمة الدستورية و الميزة الإضافية التى حققها المشرع في التعديل أنها أصبحت مؤسسة قضائية بعدما كانت سياسية ، و بالتالي أصبحت لها إستقلالية كاملة مما كان لها إنعكاس إيجابي علي الرقابة في العملية الإنتخابية ، و القضاء الذي لا يقل أهمية عن المحكمة الدستورية في سير العملية الإنتخابية عبر جميع مراحلها ، وسعيا منها إلى تحقيق إنتخابات شفافة و نزيهة تعكس شرعية المؤسسات الدستورية في الدولة . الكلمات المفتاحية: الانتخاب، السلطة الوطنية المستقلة لمراقبة الانتخابات، المحكمة الدستورية.

Summary The mechanism of administrative and judicial protection, as well as the consecration of the standards of independence and credibility for the transparency and legitimacy of the electoral process, are considered a real gain for the nation in order to achieve the democratic transition and achieve the principle of peaceful transfer of power. Résumé Le mécanisme de protection administrative et judiciaire, ainsi que la consécration des normes d'indépendance et de crédibilité pour la transparence et la légitimité du processus électoral, sont considérés comme un réel acquis pour la nation afin de réaliser la transition démocratique et réaliser le principe de l'Autorité Nationale Indépendante pour les Elections était un acquis constitutionnel pour l'année 2020 en tant que garantie de la transparence des élections dans les différentes étapes qui se déroulent.
