يعد المجلس الأعلى للقضاء في الجزائر من أهم المؤسسات الدستورية، و الذي يعكس التكريس الفعلي لمبدأ الفصل ما بين السلطات، و تعزيز السلطة القضائية عن باقي السلطات التشريعية و التنفيذية الموجودة في الدولة، و على ضوء هذه المبادئ الأساسية ، تم إنشاء المجلس الأعلى للقضاء بموجب أحكام الدساتير التي عرفتها الجزائر، من أجل ضمان ، بغية إشرافه على متابعة المسار المهني للقاضي بمختلف جوانبه ، منذ بدايته إلى غاية إنهاء مهامه، و كذا مساءلته تأديبيا. إن المجتمع ينظر إلى رجل العدالة المتمثل في القاضي كشخص لا يشوبه عيب أو شبهة ، لأنه المسؤول عن تحقيق العدالة.غير أن المخالفة أو الإخلال بالواجبات المهنية تعرض القاضي إلى المساءلة التأديبية ، ولقد كرس المشرع الجزائري بنصوص صريحة مسؤولية القاضي في حالة إرتكابه للأخطاء التأديبية ، وخول للسلطة التأديب أن توقع عليه جزاءات تأديبية تتناسب مع درجة جسامة الخطأ المرتكب. الكلمات المفتاحية: المجلس الأعلى للقضاء، السلطة القضائية ، القاضي، العدالة. Summary: The SupremeJudicial Council in Algeriaisconsidered one of the most important constitutional institutions, whichreflects the actualdedication to the principle of separation of powers and the strengthening of judicialauthorityfrom the rest of the legislative and executiveauthoritiespresent in the state. In light of these basic principles, the SupremeJudicial Council wasestablished In accordance with the provisions of the constitutions known in Algeria, in order to ensure, in order to supervise the follow-up of the judge'sprofessionalcareer in itsvarious aspects, from the beginninguntil the end of hisduties, as well as holding himdisciplinaryaccountable. Society views the man of justice represented by the judge as a personwithoutanydefect or suspicion, becauseheisresponsible for achieving justice. However, a violation or breach of professionalduties exposes a judge to disciplinaryaccountability, and the Algerian legislator has explicitlyestablished the judge'sresponsibility in the eventhecommitsdisciplinaryerrors, and has authorized the disciplinaryauthority to impose disciplinary penalties on himcommensuratewith the degree of gravity of the committederror. Keywords:SupremeJudicial Council, judicialauthority, judge, justice Résumé: Le Conseil supérieur de la magistrature en Algérie est considéré comme l'une des institutions constitutionnelles les plus importantes, ce qui reflète l'attachement actuel au principe de séparation des pouvoirs et au renforcement de l'autorité judiciaire du reste des autorités législatives et exécutives présentes dans l'?tat. de ces principes fondamentaux, le Conseil Supérieur de la Magistrature a été institué conformément aux dispositions des constitutions connues en Algérie, afin d'assurer, afin de superviser le suivi de la carrière professionnelle du juge dans ses différents aspects, depuis le début jusqu'à la fin de ses fonctions, ainsi que de lui demander des comptes disciplinaires. La société considère l'homme de justice représenté par le juge comme une personne sans aucun défaut ni soupçon, car il est responsable de l'obtention de la justice. Toutefois, une violation ou un manquement aux devoirs professionnels expose le juge à une responsabilité disciplinaire et le législateur algérien a explicitement établi la responsabilité du juge en cas de fautes disciplinaires et a autorisé l'autorité disciplinaire à lui infliger des sanctions disciplinaires proportionnées au degré de la gravité de l'erreur commise.
