| dc.description | إنالسكن يشكل بالنسبة للفرد، الأسرة والمجتمع حاجة اجتماعية أساسية، وتحقيقها يعتبردليلا على نوعية التنمية والرفاهية الاجتماعية، ومع ذلك فإن قطاع السكن منذ الإستقلال سجلتأخرا محسوسا إضافة إلى ازدياد النمو الديمغرافي والنزوح الريفي نحو المدن، ما سبب فيتفشي أزمة السكن التي تنمي عدم الاستقرار في المجتمع وتعرقل تطوره، لذا سعت الجزائر إلىتجنيدكل الوسائل للتخفيف من هذه الأزمة ولما لا الحد منها ومن بينها فتح مجال الاستثمار فيقطاع السكن لكل شخص طبيعي أو معنوي يتمتع بإمكانيات ووسائل مالية وتقنية، وعليه اتجه المشرع الجزائري الى وضع قواعد لتنظيم النشاط الترقية العقارية بداية من خلال المرسوم التنفيذي رقم 86-07 المتعلق بالترقية العقارية الذي جاء أساسا لتنظيم هذا المجال لأول مرة ثم جاء مرسوم التنفيذي 93-03 المتعلق بالنشاط العقاري الذي أحدث مصطلح البيع على التصاميم إلى أن أصدر المشرع الجزائري القانون 11-04 المحدد للقواعد التنظيم نشاط الترقية العقارية. الكلمات المفتاحية: السكن، الاستثمار، النشاط الترقية العقارية. Summary: For the individual, the family and society, housingconstitutes a basic social need, and achievingitisconsideredevidence of the quality of development and social well-being. Withfinancial and technicalcapabilities and means, the Algerian legislatordecided to set rules to regulate real estate promotion activity, beginningwithExecutiveDecree No. 86-07 related to real estate promotion, which came as a basis for regulatingthisfield for the first time. Résumé: Pour l'individu, la famille et la société, le logement constitue un besoin social fondamental et sa réalisation est considérée comme une preuve de la qualité du développement et du bien-être social. Cependant, depuis l'indépendance, le secteur du logement a enregistré un retard important en plus du retard. L'augmentation de la croissance démographique et l'exode rural vers les villes, qui ont provoqué une crise du logement qui s'étend, crée une instabilité dans la société et entrave son développement. L'Algérie a donc cherché à mobiliser tous les moyens pour atténuer cette crise, et pourquoi pas la réduire. notamment en ouvrant le champ de l'investissement dans le secteur de l'habitat à toute personne physique ou morale qui en bénéficie... Doté de capacités et de moyens financiers et techniques, le législateur algérien a décidé de fixer des règles pour encadrer l'activité de promotion immobilière, à commencer par le décret exécutif n°86. -07 relatif à la promotion immobilière, qui a servi de base à la réglementation de ce domaine pour la première fois. Puis est venu le décret exécutif n° 93-03 relatif à l'activité immobilière, qui a introduit le terme de vente sur plans jusqu'au législateur algérien. a promulgué la loi 11-04 précisant les règles régissant l'activité de promotion immobilière.
