Abstract

الملخص: تعد المحكمة الإفريقية للعدل وحقوق الإنسان إحدى أهم الهيئات القضائية الإقليمية التي أنشأها الاتحاد الإفريقي بهدف تعزيز وحماية حقوق الإنسان والشعوب في القارة الإفريقية، حيث جاءت هذه المحكمة نتيجة دمج بين المحكمة الإفريقية لحقوق الإنسان والشعوب ومحكمة العدل التابعة للاتحاد، ما منحها طابعا متميزا واختصاصًا مزدوجًا يشمل القضايا القانونية العامة وقضايا حقوق الإنسان، وحتى الجرائم ذات الطابع الدولي. وتتمثل أهميتها في اختصاصاتها الواسعة وإمكانية النظر في شكاوى الأفراد والمنظمات، مما يعزز النفاذ إلى العدالة، غير أن المحكمة تواجه تحديات جدية تتعلق بتنفيذ أحكامها ومدى التزام الدول بقراراتها، ومن هنا تطرح الدراسة إشكالية محورية حول مدى قدرة المحكمة الإفريقية للعدل وحقوق الإنسان من أداء دور فعال في حماية حقوق الإنسان في إفريقيا في ظل هذه التحديات القانونية والتنفيذية

The African Court of Justice and Human Rights is one of the most important regional judicial institutionsestablished by the African Union to promote and protect human and peoples' rights across the continent. This court emerged from the merger of the African Court on Human and Peoples’ Rights and the African Union Court of Justice, granting it a unique and dual jurisdiction over general legal disputes, human rights issues, and international crimes. Its broad competence and the ability to receive complaints from individuals and NGOs enhance access to justice. However, the Court faces serious challenges related to the enforcement of its decisions and the degree of state compliance. This raises the central research question: To what extent has the African Court of Justice and Human Rights played an effective role in protecting human rights in Africa amidst these legal and implementation challenges
