إختصاص مجلس الدولة في ظل القانون العضوي 12-11 المتعلق بتنظمي مجلس الدولة وسيره وإختصاصاته

Abstract

لقد جاء القانون العضوي رقم 22-11 المؤرخ في 09/06/2022 ، المعدل و المتمم للقانون العضوي 98-01 الخاص بتنظيم مجلس الدولة و سيره و اختصاصاته من أجل تكريس دور مجلس الدولة كجهة نقض في المواد الإدارية بحيث تتمثل مهمته الأساسية في ضمان توحيد الاجتهاد القضائي و احترام مبدأ المشروعية من خلال الحرص على ضرورة احترام القرارات الإدارية لأحكام القانون . الكلمات المفتاحية: مجلس الدولة ؛ الطعن بالاستئناف ؛ الطعن بالنقض ؛ النقض الإداري. Abstract: Organic Law No. 22-11 of 09/06/2022, amending and supplementing Organic Law No. 98-01 on the Organization, Functioning and Competencies of the Council of State, Its main task is to ensure uniformity of jurisprudence and respect for the principle of legality by ensuring that administrative decisions must respect the law's provisions. Résumé : La Loi organique n° 22-11 du 09/06/2022, modifiant et complétant la Loi organique n° 98-01 sur l'Organisation, le Fonctionnement et les Compétences du Conseil d'Etat, Sa tâche principale est d'assurer l'uniformité de la jurisprudence et le respect du principe de légalité en veillant à ce que les décisions administratives respectent les dispositions de la loi.
