02-اللغة الانجليزيـــــــــــــة : It appearsclearlythat the principle of the presumption of innocence, whichmeansthatsomeoneaccused of a crime, no matter how serious, must betreated as an innocent personuntilhisguiltisproven by a final judicialrulingissued by a fair trial. It isrecognized in most international and regionalhumanrightsmechanisms, as well as the internallegislation of countries, whether the constitution or the Body of lawCriminalprocedures, or bothtogether. This principle has resulted in manyresults, as the burden of proof remains on the accusation authority, and doubtisalwaysinterpreted in favor of the accused. Among the results are also the right of the accused to remainsilent and the necessity of respecting the freedom of the accused. The issue of the accuser's right to silence is of great importance as itis one of the guaranteesemanatingfrom the principle of the presumption of innocence, whichisknown as the accuser'srefusal to answer, providedthatthis silence is not construed to harmhisinterest or beusedagainsthim in anyway as proof. This right maybeexposed to many practices and risksthatmaythreatenits existence, as they do not respect hisfreedom to refrain frommaking a statement, as well as his right to defense, whichisdividedintotraditional practices, such as physicalcoercion, whichincludes torture and prolonged interrogation, as well as moral coercion, represented by promises and threats, and also the use of police dogs, not to mention Regarding the talk about hypnosis and the lie detector device, which the Algerian legislatorrecognized as illegal, the otherriskswererepresented by the interpretation of silence thatis not in the interest of the accused, as well as whatisrelated to freedom of proof, as well as whatisrelated to the principle of personal conviction of the criminaljudge 03-اللغة الفرنسيـــــــــــــــــــة: Il apparaît clairement que le principe de la présomption d'innocence, qui signifie qu'une personne accusée d'un crime, aussi grave soit-il, doit être traitée comme une personne innocente jusqu'à ce que sa culpabilité soit prouvée par une décision judiciaire définitive rendue à l'issue d'un procès équitable. est reconnue dans la plupart des mécanismes internationaux et régionaux des droits de l'homme, ainsi que dans la législation interne des pays, qu'il s'agisse de la constitution ou du corpus juridique Les procédures pénales, ou les deux ensemble.
