تقديم بيان السياسة العامة في ظل التعديل الدستوري 2020

Abstract

ملخص: من خلال ما تعرض إليه من خلال هذه الدراسة التي تناولنا فيها مختلف الآليات الرقابية التي تمارسها المؤسسة التشريعية على الجهاز التنفيذي و المرتبطة ببيان السياسة العامة، تبين لنا أن عملية الرقابة البرلمانية تشكل لبنة أساسية في بناء النظام الرقابي للدولة فهي اختصاص أصيل للبرلمان، هذا الأخير الذي يمارسها عن طريق آليات رقابية مرتبة وغير مرتبة للمسؤولية السياسية تجاه العمل الحكومي، ضمانا لمواكبة دواليب الديمقراطية، لذلك نجد المؤسس الدستوري من خلال التعديل الدستوري لسنة 2020، سعى جاهدا لتفعيل المجال الرقابي للبرلمان محاولا بذلك معالجة الثغرات الدستورية، وتحقيق التوازن بين السلطات ومنح البرلمان المكانة الحقيقية اللائقة به، خاصة ما تعلق بشقه الرقابي، وكان من أهم المستجدات التي جاء بها هي الاستجواب كآلية مرتبة للمسؤولية السياسية بالرغم من النقائص التي بقيت موجودة في مجال الرقابة، والذي كان من المنتظر معالجتها في هذا التعديل الدستوري لسنة 2020. Abstract : Through what was addressed in this study, in which talked the various oversight michanisms exercised by legislative institutions on the excutive bodY : it was found that parliamentary oversight is an essential building block in building the state’s regulatory system.For it is a genuine specialty of the parliament , the later exercising in by means of regulatory mechanisms arranged and unarranged for political responsibility towards governement work ti ensure keeping with the wheels of democracy.Hense, THROUGH the constitutional amendement 2020, We find that the constitutional founder strived to activate the oversight filed of parliament, Tying to address constitutional gaps, achieve balance between powers and grant parliament its rightful status, especially regarding its oversight area. Mpreover , one of the most prominent novelties that were brought in, was the interrogation as an arranged mechanisms for political responsibility despite the shortcomings that remained in the fieled of oversight, wich were expected to be addressed in this constitutional amandement for the year 2020. Résumé : A travers cette étude, qui a porté sur les differents mécanismes de contrôle exercés par l’institution législative sur l’exécutive en lien avec la déclaration de politique générale, il ressort que le contrôle parlementaire constitue une pierre angulaire dans la construction du système de contrôle de l’ETAT . IL s’agit d’une comPétence fondamentale du parlemant . Ainsi le constituant à travèrs la révision constitutionnelle de 2020, a cherché à renforcer le rôle de contrôle du parlement.L’ une des nouveautés les plus importantes introduites par cette révision est l’interpellation, considérée comme un mecanisme structuré de mise en jeu de la responsabilité politique, et ce malgré les lacunes qui substent encore dans le domaine du contrôle, lesquelles étaient pourtant censées être corrigées par cette Révision de 2020.
