Abstract
This dissertation examines Wilayat al-Ahd (designation of the heir apparent) in the Maghreb and al-Andalus during the era of the independent emirates (2nd–4th AH / 8th–10th CE). The study adopts a historical–analytical approach and is structured into four chapters. It begins by exploring the concept of the heir apparent, its legal status in Islamic jurisprudence, and the circumstances of its emergence and development in the eastern Islamic world, with particular attention to the political, historical, and juridical foundations that contributed to its consolidation.
The study then turns to an in-depth examination of its practical application and consequences within three political entities: the Umayyad Emirate of al-Andalus, the Rustamid Emirate in the Central Maghreb, and the Idrisi Emirate in the Far Maghreb. The dissertation focuses on analyzing the impact of the designation of an heir apparent on political stability and instability, as well as its broader implications for systems of governance within these emirates. It demonstrates that, while this practice at times contributed to the consolidation and continuity of authority, in other instances it became a catalyst for internal conflict and political fragmentation.
The study concludes that the designation of an heir apparent was a political practice shaped and imposed by historical realities, and that its outcomes varied according to the specific political contexts in which it was applied in each emirate. Consequently, it cannot be regarded as a fixed or immutable system in itself, but rather as an ijtihād-based mechanism whose legitimacy is measured by the extent to which it realizes public interests, prevents harm, and accords with the higher objectives of governance in Islam, its normative aims, and the ultimate consequences it engenders.
