ضمانات وحوافز الإستثمار في ظل القانون الجديد

Abstract

ن القانون الجديد المتعلق بالاستثمار رقم 22-18 رسم الخطوط العريضة و حدد القواعد الاساسية للاستثمار في الجزائر لا سيما في ما يتعلق بالضمانات والحوافز و ذلك من خلال الاسس القانونية و الأنظمة القضائية المختصة في هذا المجال و قد حاول المشرع من خلال النصوص التشريعية المنظمة للاستثمار فتح مجال واسع أمام المستثمرين المحليين و الاجانيب من خلال تسهيلات و الحوافز مع مراعاة المصلحة الوطنية كما حاول المشرع تدارك النقائص المسجلة في تنظيميات التشريعات السابقة

Summary The new law related to investment No. 22-18 drew broad lines and defined the basic rules for investment in Algeria, especially with regard to guarantees and incentives, through the legal foundations and judicial systems specialized in this field. The legislator has tried, through the legislative texts regulating investment, to open a wide field for local and foreign investors through facilities and incentives, taking into account the national interest. The legislator has also tried to remedy the deficiencies recorded in the previous legislation regulations.

Résumé La nouvelle loi relative à l'investissement n° 22-18 a tracé les grandes lignes et défini les règles de base de l'investissement en Algérie, notamment en matière de garanties et d'incitations, à travers les fondements juridiques et les systèmes judiciaires spécialisés dans ce domaine. Le législateur s'est efforcé, à travers les textes législatifs réglementant l'investissement, d'ouvrir un large champ aux investisseurs locaux et étrangers par des facilités et des incitations, en tenant compte de l'intérêt national. Le législateur a également tenté de remédier aux insuffisances enregistrées dans les réglementations législatives antérieures.
