Abstract

ملخص مذكرة التخرج أولا : باللغة العربية في ظل النقائص الجوهرية و الآثار السلبية التي تشوب نظام إثبات الملكية العقارية و تطهيرها، والتي تُعد نتيجة مباشرة للسياسات الاستعمارية في تنظيم العقار ،ثم لاحقًا لاعتماد عقد الشهرة بموجب المرسوم التنفيذي رقم 83-352 المؤرخ في ماي 1983 ، و الذي كان يهدف إلى الاعتراف بالملكية بناءً على التقادم ، بادر المشرّع الجزائري إلى إصلاح هذا النظام عبر إلغائه واستبداله بالقانون رقم 07-02 الصادر بتاريخ 27 فيفري 2007 ، ينص هذا القانون على إنشاء إجراء جديد للتحقيق العقاري ، يهدف إلى معاينة حقوق الملكية العقارية و تسليم سندات ملكية قانونية تثبتها ، يقوم بهذا التحقيق محقّق عقاري يتولى التحقق من قيام حق الملكية وفقًا لإجراءات مضبوطة تحت إشراف و إدارة مصالح الحفظ العقاري، وتنتهي هذه العملية بمنح عقود ملكية رسمية للأشخاص المستحقين. الكلمات المفتاحية : التحقيق العقاري ، تطهير الملكية ، المعاينة ، سند الملكية

Face aux lacunas fundamentals et aux effets négatifs dans le domaine de la preuve et de la régularisation de la propriété foncière, résultant directement des politiques coloniales en matière d'organisation foncière, puis, après l’indépendance, de l'application du contrat de notoriété conformément au décret exécutif n° 83-352 du 21 mai 1983, visant à reconnaître la propriété par prescription, le législateur algérien a entrepris une réforme en abrogeant ces dispositions et en les remplaçant par la loi n° 07-02 du 27 février 2007. Cette loi instaure une nouvelle procédure d’enquête foncière destinée à constater le droit de propriété immobilière et à délivrer des titres de propriété légaux. L’enquête est menée par un enquêteur foncier chargé de vérifier l’existence du droit de propriété à travers des étapes précises, sous la supervision et la gestion des services de la conservation foncière. Le processus se conclut par la délivrance de titres de propriété aux ayants droit.

Due to the fundamental shortcomings and negative impacts in the field of proving and regularizing property ownership — initially caused by colonial land management policies and later by the use of the notoriety deed under Executive Decree No. 83-352 of May 21, 1983, which aimed to recognize ownership through prescription — the Algerian legislator initiated reforms by repealing this decree and replacing it with Law No. 07-02 of February 27, 2007. This law establishes a new procedure called "land investigation," which aims to verify property ownership rights and issue official ownership deeds. The investigation is carried out by a land investigator who confirms the existence of ownership through specific procedures under the supervision and management of the land registry services. The process concludes with the issuance of ownership deeds to the rightful persons.
